Setback for Morena Baccarin in divorce case

Some Tennessee television fans may have been following the divorce of actress Morena Baccarin. Her husband, Austin Chick, filed for divorce in July 2015. Initially the two planned to remain in New York with shared custody of their 2-year-old son, but on learning that his estranged wife was dating her co-star from the TV show "Gotham," Chick moved to California. Baccarin is pregnant with the child of her co-star.

On Nov. 19, a judge ordered Baccarin to pay Chick $2,693 per month in child support. She was also ordered to pay him $20,349 per month in spousal support. Baccarin pays upwards of $500 per month in health insurance, so the total will be adjusted to account for that.

Unless Chick remarries, she will be obligated to pay support to him for the rest of his life. Another hearing is scheduled for the couple in June 2016.

A prenuptial agreement might have made the divorce go more smoothly for Baccarin. However, prenuptial agreements can be challenged in court, and whatever preparations people have made, they may find themselves facing the possibility of paying spousal support. In other cases, a person may need spousal and child support after a divorce. At times, spousal or child support must be modified due to a change in life circumstances. It is not legal to simply stop paying support regardless of these life changes. A person must seek an order modification if it becomes necessary.
