Sherri Shepherd loses final child support appeal

Early-morning network television watchers in Tennessee may be aware of the recent legal problems facing Sherri Shepherd, former co-host of "The View", in relation to her attempts to relinquish custody of her 1-year-old surrogate son with ex-husband Lamar Sally. Following a failure to obtain a second appeal with the highest court in her state, she will have to uphold her obligations of child support for the boy.

The marriage between Sally and Shepherd, both 48, began to fall apart in May 2014 after the 23-year-old woman they chose to carry the baby was already in the second trimester of pregnancy. Shepherd, who does not share any biological connection to the baby, had already agreed in a surrogacy contract to include her name on his birth certificate along with Sally. Sally requested full custody of the baby in July 2014, a month before his birth, and Shepherd's first legal attempt to avoid her inclusion on the birth certificate in court was rejected in April 2015.

Following her initial legal defeat, Shepherd filed an appeal that was rejected in November 2015 before the Supreme Court rejected her appeal on March 1 of this year. Her current monthly obligation to the child totals $4,100.

Even when the issue is not complicated by a factor such as a surrogate pregnancy, child support expectations may often lead to frustration for a divorced parent. Sometimes, a non-custodial parent's financial status can decline, and a modification of the monthly payment can be necessary. An attorney with experience in child support disputes can often assist such a parent in seeking a modification of the order.
