Family preparedness plans help parents transfer child custody

Undocumented immigrants who are living in Tennessee might not have already made plans for their American-born children in case of deportation. It is possible for them to make arrangements, however. Some lawyers are volunteering in different parts of the country to assist immigrants without documentation with filling out and filing the paperwork needed to transfer child custody.

If people are deported by U.S. Immigration and Customs Enforcement but they have children who are United States citizens, then their children can be transferred to a designated caregiver. Some parents want to arrange for a guardian to take care of their children until they can be reunited with them in their home country. Other parents choose to prepare to give custody of their children over to an adult relative because they are concerned that their country of origin could be too dangerous.

Having a plan in place means that the children can be transferred smoothly and legally to a trusted individual. Being prepared with signed legal documents could help alleviate some of the stress of a deportation situation because the parent is able to prioritize the best interests of their children.

If parents want to start reviewing their options for making such a plan, a good first step would be to speak with a lawyer. Counsel could work with them to put together a packet of the necessary paperwork for the transfer of legal and physical custody of their children to a trusted individual as well as the transfer of assets, such as a home, in the event that they are deported.
